1. Definitions
"Company" refers to Always Present: Photo Booth & Events Co., the provider of photo booth rental services.
"Service" refers to the provision of a photo booth, appropriate software, props, technical support, and other related services as detailed in the event agreement.
2. Services Provided
The Company agrees to provide the Service as described in the specific order details and event agreement provided to the client. This includes the delivery, setup, operation, and breakdown of a photo booth for the duration specified in the client’s booking confirmation.
3. Rental Period
The rental period will be as stated in the client’s booking confirmation. The Company will aim to arrive for setup approximately 60-90 minutes prior to the agreed start time. Early setup or delayed operation times will require prior arrangement and may be subject to additional charges.
4. Payments and Retainers
A non-refundable retainer of 25% of the total booking fee is required to secure the event date. The remaining balance is due no later than 14 days before the event date. Payments can be made via Honeybook utilizing a credit card, bank transfer, or other pre-agreed methods.
5. Cancellations
If the event is canceled within 14 days of the scheduled date, the client is responsible for the full rental cost. Cancellations made more than 14 days prior to the event date will result in the forfeiture of the retainer only.
6. Access, Space, and Power Requirements
Clients are responsible for ensuring a safe and appropriate environment for the Service. This includes providing a 10x10 ft space, access to power outlets, and suitable protection from adverse weather conditions if outdoors. Clients must also ensure the venue allows reasonable access for setup prior to the event start.
7. Use of Images
The Company may use images taken at events for promotional material and social media unless otherwise agreed with the client. By using the Service, clients and event guests grant the Company permission to use their images for such purposes.
8. Equipment
The Company ensures that all equipment is in good working order and reserves the right to substitute equipment of a similar type in the event of technical failure.
9. Indemnification
Clients agree to indemnify and hold the Company harmless from any claims, lawsuits, damages, losses, penalties, and expenses arising from the use of the Service or breach of this agreement by the client.
10. Limitations on Liability
The Company will not be liable for any indirect, incidental, or consequential damages arising from the use of the Service, exceeding the total amount paid by the client.
11. Force Majeure
Neither party will be responsible for any failure or delay in performing its obligations under this agreement due to causes beyond its reasonable control, including but not limited to acts of God, war, strikes, or governmental action.
12. Governing Law
This agreement shall be governed by and construed in accordance with the laws of the state in which the Company operates, in this case Arizona.
13. Agreement Modifications
No modification of this agreement shall be effective unless it is in writing and signed by both parties. This agreement constitutes the entire agreement between the Company and the client.
14. Privacy Policy
Client information will be used only as detailed in the Always Present: Photo Booth & Events Co. Privacy Policy, which addresses the use, storage, and protection of client data.
